NSW: LGA considers appealing cable decision
SYDNEY, April 5 AAP - The NSW Local Government Association (LGA) may appeal a FederalCourt decision that charges applied to Telstra and Optus for laying cables on public landwere unconstitutional.
Victorian and NSW councils yesterday lost a potential tax windfall worth millions afterthe court upheld an appeal by the telecommunication giants against a ruling which allowedthe 15 councils to charge for cabling on public land.
A spokesman for the LGA said its lawyers were currently reviewing the decision to decidewhether to appeal against it.
The Victorian councils involved have said they would continue with legal action againstOptus and Telstra.
In December 2000, a single judge in the Federal Court found 15 councils in NSW andVictoria were able to charge Telstra and Optus for laying their cables across suburbs.
NSW councils involved in the action include Leichhardt, Blacktown, Parramatta and Hornsby.
